1.1 Agreement to Terms

By accessing or using this website ("My Site") and purchasing products from Messy Soul Prints ("I" or "My"), you agree to be bound by these Terms and Conditions (TCs) and all policies incorporated herein by reference, including My Privacy Policy and My Returns Policy. If you do not agree to these terms, you may not use My Site or purchase My products.

1.2 Legal Capacity

You affirm that you are at least 18 years of age or possess legal parental or guardian consent and are fully competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties outlined in these Terms and Conditions. (Translation: It’s not cool to steal off your parents or guardians so just dont do it. I wont have your back.)

2.1 Ownership of Content

All original designs, photographs, graphics, text, branding, logos, product descriptions, video, and other content ("My IP") displayed on My Site are My exclusive property and are protected by United Kingdom and international copyright and intellectual property laws.

2.2 Restrictions on Use

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use My Site for your personal, non-commercial use only. You may not copy, reproduce, distribute, transmit, display, sell, license, or otherwise exploit any of My IP for any commercial purpose without My express prior written consent.

2.3 Custom Work and Licensing

Unless otherwise explicitly agreed in writing, I retain all ownership rights and copyright to any custom-commissioned work I create for a customer. The customer is only purchasing the physical piece; they are not purchasing the intellectual property rights to the design or underlying concept. (You bought the painting, not the right to print more of it.)

3.1 Product Description

I attempt to be as accurate as possible in product descriptions. However, I do not warrant that product descriptions or other content on My Site are entirely accurate, complete, reliable, current, or error-free.

3.2 Acknowledgement of Flaws (The Messy Soul Prints Clause)

YOU ACKNOWLEDGE AND ACCEPT THAT ALL PRODUCTS SOLD BY MESSY SOUL PRINTS ARE INTENTIONALLY FLAWED, IMPERFECT, UNIQUE, AND/OR CUSTOM-MADE. Variations in colour, texture, shape, printing alignment, and finish are inherent characteristics of the product and design process, and are not considered manufacturing defects. The aesthetic decision to embrace these "flaws" is fundamental to the product's value. (Again, you were warned.)

3.3 Pricing and Availability

All prices are subject to change without notice. I reserve the right to refuse or cancel any order placed for any reason, including limitations on quantities or errors in pricing or product information.

4.1 Shipping and Delivery

I will ship products to the address you provide. Shipping dates are estimates and are not guaranteed. I am not liable for delays in shipping or delivery caused by the carrier. (I'm an artist, not a logistician.)

5.1 Governing Policy

Returns and refunds are governed by My separate Returns Policy (linked here).

5.2 Finality of Sales

Due to the custom and intentionally flawed nature of My goods, all sales are considered FINAL. I will only process refunds or replacements for items demonstrably damaged in transit, subject to the conditions detailed in My Returns Policy (e.g., photo evidence and notification within 14 days). No returns are accepted based on aesthetic disagreement with the intended imperfections or flaws.

6.1 Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis. I expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

6.2 Limitation of Liability

In no event shall I be liable for any indirect, punitive, incidental, special, or consequential damages arising out of, or in any way connected with, the use of My Site or the purchase of My products, whether based in contract, tort, strict liability, or otherwise, even if I have been advised of the possibility of damages. My total liability shall not exceed the total amount paid by you for the specific product in question.

7.1 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

7.2 Dispute Resolution

Any disputes arising out of these Terms and Conditions shall be resolved by binding arbitration in London, UK, or in the local small claims court, at My sole discretion. (Your choice is irrelevant; the resolution is My choice.)
